1. Terms & Conditions of Use

Thank you for visiting www.maintel.co.uk (“Maintel Site”). Maintel Holdings Plc and/or its affiliates (together and individually, “Maintel”) makes the Maintel Site available to you subject to these terms and conditions of use.

By accessing the Maintel Site you accept these terms and conditions of use and agree to comply with them. If you do not agree to these terms, you must not use the Maintel Site.

Maintel recommends that you print a copy of these terms for future reference. Maintel may amend these terms and conditions at any time and without notice. Every time you wish to use the Maintel Site, please check these terms to ensure you understand the terms that apply at that time.

The Maintel Site is directed to people residing in the United Kingdom. Maintel does not represent that content available on or through the Maintel Site is appropriate for use or available in other locations.

2. Intellectual Property Rights

Trade marks

Maintel (the figurative mark displayed on the Maintel Site) is the registered trade mark of Maintel Holdings Plc. Product or service names mentioned on the Maintel Site may be trade marks of Maintel Holdings Plc or its affiliates, or third party companies. You are not permitted to use the trade marks without Maintel’s approval, unless they are part of material you are using as permitted by these terms and conditions of use.

Use of material on the Maintel Site

Maintel is the owner or licensee of all intellectual property rights in the Maintel Site and in the material published on it. Maintel reserves such rights. The Maintel Site (including its content) should not be copied or re-used without Maintel’s permission.

You may distribute the content of the Maintel Site as long as this is for personal, non-commercial, information only purposes and may draw the attention of others within your organisation to content posted on the Maintel Site. You must not use any part of the content on the Maintel Website for commercial purposes without obtaining a licence to do so from Maintel or its licensors.

You must not modify any of the content you print off or download, and must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Maintel’s status (and that of any identified contributors) as the authors of content on the Maintel Site must always be acknowledged.

If you print off, copy, download, share or repost any part of the Maintel Site in breach of these terms and conditions of use, your right to use the Maintel Site will cease immediately and you must, at Maintel’s option, return or destroy any materials you have made (except that you are permitted to print off a copy of these terms of service).

Linking to the Maintel Site

You may link to our home page, provided that you do so in a way that is fair and legal and does not damage Maintel’s reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on the part of Maintel where none exists. You must also not establish a link to the Maintel Site in any website that is not owned by you.

The Maintel Site must not be framed on any other site, nor may you create a link to any part of the Maintel Site other than the home page.

Maintel reserves the right to withdraw linking permission without notice.

The website in which you are linking must comply in all respects with Maintel’s Acceptable Use Policy HERE .

3. Information and General Disclaimer

The contents of the Maintel Site have been produced in good faith and are only for general information or use. They do not constitute advice and should not be relied upon in making (or refraining from making) any decision.

Although Maintel endeavours to keep all information on the Maintel Site as accurate and updated as possible, the information herein may occasionally include technical inaccuracies or typographical errors and may be out of date. Maintel is not bound by any wrongfully presented offers or prices and has the right to withdraw an offer on the Maintel Site at any time, should this be required.

Changes may be made to the Maintel Site and services/products on an ongoing basis and Maintel is not obliged to notify users in advance of this happening, nor is Maintel bound to continue to offer services or products that have been part of a previous, but no longer existing, offer on the Maintel Site.

Maintel does not guarantee that the Maintel Site, or any content on it, will always be available or be uninterrupted. Maintel may suspend or withdraw or restrict the availability of all or any part of the Maintel Site for business or operational reasons.

Maintel is not responsible for any damage that could occur to a third party and/or its systems as a result of the interpretation of the information on the Maintel Site. All visitors to the Maintel Site shall be responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed for access to and use of the Maintel Site and all charges related thereto.

4. No Test or Data Mining, or Web Scraping

You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to the Maintel Site for any purpose. This includes using (or permitting,authorising or attempting the use of):

  • Any “robot”, “bot”, “spider”, “scraper” or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of the Maintel Site or any data, content, information or services accessed via the same.
  • Any automated analytical technique aimed at analysing text and data in digital form to generate information or develop, train, fine-tune or validate AI systems or models which includes but is not limited to patterns, trends and correlations.

The provisions in this clause should be treated as an express reservation of Maintel’s rights in this regard, including for the purposes of Article 4(3) of the Digital Copyright Directive ((EU) 2019/790).

This clause will not apply insofar as (but only to the extent that) Maintel is unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to Maintel.

5. Liability

The Maintel Site is provided on an “as is” and “as available” basis, and to the maximum extent permitted by law, Maintel excludes all implied conditions, warranties, representations or other terms that may apply to the Maintel Site or any content on it, including but not limited to: (a) warranties of title or non-infringement, (b) implied warranties of merchantability, use of reasonable care and skill or fitness for a particular purpose, and (c) representations, warranties or guarantees (whether express or implied) in relation to the availability or reliability of the Maintel Site, or that the content on the Maintel Site is accurate, complete or up to date.

Maintel will not be liable for any direct, indirect, incidental, special or consequential damages arising out of the use of or inability to use the Maintel Site, even if Maintel has been advised of such damages. In particular, Maintel will not be liable for loss of profits or business interruption.

Certain jurisdictions do not allow exclusions of certain warranties or limitations of liability, in which case Maintel’s liability shall be limited to the greatest extent permitted by law.

6. Viruses

Although all reasonable efforts are made to ensure the Maintel Site is free from viruses and analogous threats, Maintel does not guarantee that the Maintel Site will be secure or free from bugs or viruses. You should ensure that you operate up to date virus protection software and firewall technology.

You must not misuse the Maintel Site by knowingly introducing viruses or other material that is malicious or technologically harmful, or otherwise harmfully interact with the Maintel Site or any part of it. You must not attempt to gain unauthorised access to the Maintel Site, the server on which the Maintel Site is stored or any server, computer or database connected to the Maintel Site or any other equipment or network connected with the Maintel Site. You must not interfere with, damage or disrupt any software used in the provision of the Maintel Site or any equipment or network or software owned or used by any third party on which the Maintel Site relies in any way.

You must not attack the Maintel Site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. Maintel will report any such breach to the relevant law enforcement authorities and will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Maintel Site will cease immediately.

7. Links to Other Websites

Maintel may include links to sites on the Internet that are owned or operated by third parties. By linking to any such third-party site, you shall review and agree to that site’s terms and conditions of use before using such site. You also agree that Maintel has no control over the content of that site and cannot assume any responsibility for material created or published by such third-party sites. In addition, a link to a non-Maintel site does not imply that Maintel endorses the site or the products or services referenced in the site.

8. Securities

No information on the Maintel Site shall constitute an invitation or inducement to invest in the shares or any other securities of Maintel Holdings Plc. The price of shares and securities and the income derived from them can go down as well as up and investors may not get back the amount originally invested. Past performance is not necessarily a guide to future performance.

9. Law

These terms and conditions, their subject matter and formation are governed by English law. Any dispute arising therefrom shall be subject to the exclusive jurisdiction of the English Courts.
